1. Agreement to Terms
By accessing or using
WebSculpting's website and services, you agree to be bound by these Terms of Service. If you
disagree with any part of these terms, you may not access our services.
2. Services
WebSculpting provides the following services:
- Web Design & Development
- Custom Software Development
- POS Systems
- Hospital Management Systems
- Website Maintenance & Support
The specific scope of work, deliverables, timeline, and pricing will be outlined in a separate project
agreement or proposal for each engagement.
3. Project Terms
Quotations & Proposals
All quotations are valid for 30 days from the date of issue unless otherwise specified. Prices are
subject to change based on project scope modifications.
Payment Terms
- A deposit of 50% is required before project commencement
- The remaining 50% is due upon project completion
- For larger projects, milestone-based payments may be arranged
- All payments are non-refundable once work has begun
Project Timeline
Estimated delivery dates are provided in good faith. Delays may occur due to:
- Delayed feedback or content from the client
- Scope changes or additional requirements
- Technical complexities discovered during development
4. Client Responsibilities
As our client, you agree to:
- Provide necessary content, images, and materials in a timely manner
- Provide feedback and approvals within agreed timeframes
- Ensure you have rights to all content provided to us
- Make payments according to agreed terms
- Designate a primary contact person for communication
5. Intellectual Property
Client Ownership
Upon full payment, you will own:
- The final website or software deliverables
- Custom graphics and designs created for your project
- Custom code written specifically for your project
Our Ownership
WebSculpting retains ownership of:
- Pre-existing code, frameworks, and libraries
- Development tools and methodologies
- General knowledge and skills gained during the project
Portfolio Rights
We reserve the right to display completed work in our portfolio and marketing materials unless otherwise
agreed in writing.
6. Warranties & Limitations
We warrant that:
- Work will be performed in a professional manner
- Deliverables will substantially conform to agreed specifications
- A 30-day warranty period for bug fixes is included after project completion
We do not warrant:
- Specific business results or outcomes
- Compatibility with all browsers or devices not specified in the project scope
- Third-party services or integrations beyond our control
7. Limitation of Liability
WebSculpting shall not be liable for any indirect, incidental, special, or consequential
damages arising from the use of our services. Our total liability shall not exceed the amount paid for
the specific service in question.
8. Termination
Either party may terminate a project with written notice. In such cases:
- Payment is due for all work completed to date
- Any advance payments for uncompleted work may be refunded at our discretion
- All client materials will be returned
9. Confidentiality
Both parties agree to keep confidential any proprietary information shared during the project unless
required by law or with prior written consent.
10. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of Sri Lanka. Any
disputes shall be resolved in the courts of Matale, Sri Lanka.
11. Changes to Terms
We reserve the right to modify these terms at any time. Continued use of our services after changes
constitutes acceptance of the new terms.
